TERMS OF SERVICE

The Terms of Service is a legal agreement between a service-provider and the person who wants to use that service. The person or client must agree to abide by the Terms of Service in order to use the offered service. This is the Terms of Service for all potential clients or current clients regarding services received from me, James (HVAC Graphics 360). This Terms of Service document includes my Terms, Privacy Policy, Refund Policy, Cancellation Policy, Rules, Copyrights, etc. Please read it in its entirety. If you have any questions after reading this document, I would be happy to answer them. However, once I receive an accepted quote, I will take that as a written consent/agreement to the following terms, and you are hereby notified forthwith.

 

Use of this service constitutes your understanding, agreement, and acceptance of the following Terms of Service.

 

Privacy Policy:

 

We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile.

 

When you submit for a quote or conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, company and email address. Your personal information will be used for the specific reasons stated above only.

 

We collect such Non-personal and Personal Information for the following purposes:

  1. To provide and operate the Services;

  2. To provide our Users with ongoing customer assistance and technical support;

  3. To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages;

  4. To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services; 

  5. To comply with any applicable laws and regulations.

 

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.  

 

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

 

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes we may contact you via email, telephone, text messages, and postal mail.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

By accepting a requested quote, you are agreeing to the Terms of Service. All graphic sales are final.

 

Services:

 

HVAC Graphics 360 is strictly a freelance building automation graphics design company. I (James) only provide graphical images and/or animations related to the building automation sector. I do not do system integration, live or otherwise.

 

Graphics purchased by any client from HVAC Graphics 360 can be used indefinitely with no licensing required.

All new client(s), company, or individual, get an automatic 10% off their entire first quoted job, not applicable with Change Order Quotes related to that first quoted job.

 

Once a quote has been accepted by a client, it is presumed that any agreed work shall commence and payment(s) to be received on the agreed time-frame(s). Once a project has been started, it is the responsibility of the requesting client to communicate as needed with HVAC Graphics 360 via email at hvacgraphics360@yahoo.com should there be any questions HVAC Graphics 360 may have while in the middle of working on a requested job. Periodic updates will also be given by HVAC Graphics 360 to the requesting client as agreed in the initial Quote for that job.

 

Upon completion of a quoted project, HVAC Graphics 360 will create a secured password protected shop page for the requesting company or individual. The link and password will be given to the client in the Notes section of the Invoice. Additionally, this shop page is hidden from the public web, there are no links to client shop pages on the public web of hvacgraphics360.com. The only way to get to client shop pages is to copy and paste the hyperlink provided and manually typing in the case sensitive password provided. Please note that HVAC Graphics 360 utilizes web tools to analyze what emails any graphics are being purchased by and sent to for client security and project protection.

 

Once initial payment is received, HVAC Graphics 360 will enable an unlimited use, 100% off coupon, to use on any client shop item, designated for that specific client shop, allowing for free re-downloading without waiting for technical assistance should the files get lost on the client’s end. HVAC Graphics 360 will only temporarily disable coupons in the event of an open due Invoice. Once all current invoices have been paid in full, this client coupon will be re-enabled. If for whatever reason the coupon still does not apply, please contact hvacgraphics360@yahoo.com for technical assistance.

 

On the client shop page, is where clients can review watermarked images of their projects before purchasing. All coupons get applied on the Cart page near the left of the screen just below the product image. If there are any issues found after purchasing, please contact hvacgraphics360@yahoo.com for assistance.

 

If it is found that a graphic is inaccurate due to a mistake on HVAC Graphics 360’s part, it will be fixed free of charge, promptly. If it is found that a graphic is inaccurate due to inaccurate client documents and information provided, then HVAC Graphics 360 reserves the right to request an approved Change Order Quote by the client. This Change Order will be sent to the client via their email address the same way the initial Quote was. Once a change order has been approved, HVAC Graphics 360 will commence the modifications and deliver in the time-frames described in the Change Order Quote.

 

Required Documentation:

 

HVAC Graphics 360 requests the following for specific graphic projects: Floor plans, site maps, and homepages should have good quality construction drawing PDFs, addresses, current Google Earth images and/or Google Maps, Street Views or noted depictions. Mechanicals of any kind should have good quality mechanical drawing PDFs, unit manufacturer drawings or web links, on site photos, or noted depictions. Please do not send CAD files as I do not utilize AutoCad and .dwg files or the like are unusable as source material to build graphics from.

 

Liability:

 

HVAC Graphics 360 does not take responsibility for late or overdue projects due to persistent problems in a project such as but not limited to, poor communication on the client’s end, poor documentation and/or necessary Change Orders on the client’s end. Misunderstanding on the lead time date(s) stated in the Notes section of any Quote prior to client approval and/or Invoice thereafter. Awaiting to commence work until all open Invoices are paid in full. Please see the Notes and Legal sections of any Quote and/or Invoice for further liability specifics related to the project.

By accepting a Quote, you are accepting of these terms, and that you have fully read, understood, and accepted all of the Terms of Service and Privacy Policy.

 

Copyright:

 

HVAC Graphics 360 specifically embeds a copyright into all rendered image, animated or otherwise and reserves the right to advertise on any online platform such as, but not limited to, LinkedIn, Facebook, Instagram, ect. HVAC Graphics 360 also reserves the right to feature client work on their public Dropbox portfolio.

 

If it is truly wanted by any client for HVAC Graphics 360 to NOT display their graphical projects in the way described above, please email at hvacgraphics360@yahoo.com and I simply will not showcase the requested graphics in any way, in good faith. However, HVAC Graphics 360 will always embed its copyright information into every rendered image, animated or otherwise. Client satisfaction and trust is a top priority to HVAC Graphics 360.

 

Payment(s):

 

HVAC Graphics 360 requires online credit card transactions for any and all purchases made through any Invoice and/or Online Shop. HVAC Graphics 360 uses Stripe through Wix, a third party company to handle transactions and product hand-offs to best protect the freelancer (HVAC Graphics 360) and the client. With this protection, please note that HVAC Graphics 360 only sees the card’s type, and only the last four digits of the card’s number. All other payment card information is hidden from HVAC Graphics 360. Please see Stripe’s Privacy Policy at https://stripe.com/privacy.

 

HVAC Graphics 360 does accept physical mailed checks as well under special conditions. Upon completion of a project, the paying client will only receive watermarked graphic images, animated or otherwise until the check is received and payment clears the bank in full in accordance with our agreement in the initial Quote. They will receive these watermarked graphics via email from hvacgraphics360@yahoo.com. Please check your email’s spam folders. Once payment has been received in full, HVAC Graphics 360 will enable the client company’s or individual’s 100% off coupon code to purchase and received the download link for all the project files without any watermarks.

 

Additionally, HVAC Graphics 360 also does allow for direct deposit in the event that a client company would like to add my services to their list of 1099 contractors their general company works with. This usually entails of needing a form w2 from me, James, (HVAC Graphics 360). Please email me at hvacgraphics360@yahoo.com for this inquiry.

 

HVAC Graphics 360 does NOT accept PayPal, Venmo, Apple Pay, Google Pay, Zelle, Cash App, Samsung Pay, or Square as forms of payment.

Please note the Invoice due date(s) you received. All payments are due by no later than the recorded due date on any Invoice sent by HVAC Graphics 360. Please see due date and other information in the upper right corner of the Invoice.

 

Refund Policy:

 

Due to the nature of graphical asset purchases. All sales and transactions are final and non-refundable.

 

Failed or Overdue Payment(s):

 

HVAC Graphics 360 reserves the right to send overdue or failed to pay invoices to a collections agency for payment. HVAC Graphics 360 will try to work with and communicate with the overdue client in writing via email, but if no resolution can be met once graphics have been sent to the client and cannot be taken away or disabled, HVAC Graphics 360 will have to send the overdue Invoice to a collections agency. In this event, once an invoice is in collections, HVAC Graphics 360 will bar from working with the specific client, either company or individual, remove all client shop related content from hvacgraphics360.com, delete any related coupons, and will likely not re-engage a working relationship even if the collections agency collects payment in full, including any related fees to the incident of lack of payment.

 

Please note that all graphical images, animated or otherwise that HVAC Graphics 360 provides is copyrighted under the information of HVAC Graphics 360, thus failure of payments and active use of unauthorized products henceforth is copyright infringement under Copyright Title 17.
